Welcome to From Local Lámha ("we", "us", "our", or the "Platform"). These Terms and Conditions ("Terms") govern your use of our website at fromlocallamha.ie and all related services. By accessing or using our Platform, you agree to be bound by these Terms.

From Local Lámha is operated in Ireland and these Terms are governed by Irish law.

1. Definitions

  • "Platform" means the From Local Lámha website, mobile applications, and all related services.
  • "Seller" or "Artisan" means any individual or business registered to sell products on the Platform.
  • "Buyer" or "Customer" means any individual or business purchasing products through the Platform.
  • "User" means any person accessing the Platform, whether as a Seller, Buyer, or visitor.
  • "Products" means all items listed for sale on the Platform, including handmade crafts and artisan food products.
  • "Food Products" means any edible items sold through the Platform, including but not limited to preserves, confectionery, baked goods, beverages, and other consumables.

2. Platform Role and Limitations

Important: From Local Lámha operates solely as an online marketplace platform. We provide a venue for Sellers to list products and for Buyers to purchase them. We do not manufacture, produce, store, handle, or inspect any products sold on the Platform.

2.1 What We Do

  • Provide a technology platform connecting Sellers and Buyers
  • Process payments on behalf of Sellers
  • Provide tools for Sellers to manage their listings and orders
  • Facilitate communication between Sellers and Buyers
  • Collect and verify basic registration information from Sellers

2.2 What We Do Not Do

  • We do not manufacture, produce, or create any products
  • We do not store, handle, package, or ship any products
  • We do not inspect, test, or verify the quality of products
  • We do not guarantee the accuracy of product descriptions or images
  • We do not take possession of any products at any time
  • We are not a party to the contract of sale between Seller and Buyer

3. Seller Obligations

3.1 General Obligations

All Sellers on the Platform agree to:

  • Provide accurate and complete information during registration
  • Ensure all product listings are accurate, truthful, and not misleading
  • Fulfill orders promptly and in accordance with their stated terms
  • Maintain appropriate insurance for their business activities
  • Comply with all applicable Irish and EU laws and regulations
  • Respond to customer enquiries within a reasonable timeframe
  • Handle disputes with Buyers in good faith

3.2 Food Seller Specific Obligations

Critical Food Safety Requirements: Sellers of Food Products bear sole and complete responsibility for compliance with all food safety regulations. The Platform does not verify, monitor, or guarantee compliance.

Sellers of Food Products warrant and represent that they:

  1. Are registered with the Food Safety Authority of Ireland (FSAI) as a food business operator, or are exempt from registration under applicable legislation
  2. Have been inspected and approved by their local Environmental Health Office where required
  3. Maintain appropriate food hygiene standards in accordance with Regulation (EC) No 852/2004 and Irish food safety legislation
  4. Have implemented HACCP principles (Hazard Analysis Critical Control Points) where required
  5. Comply with all food labeling requirements including:
    • Full ingredient lists in descending order of weight
    • Declaration of all 14 EU allergens as per Regulation (EU) No 1169/2011
    • Net quantity/weight
    • Best before or use by dates where applicable
    • Storage and usage instructions
    • Business name and address
    • Country of origin where required
    • Nutritional information where required
  6. Maintain product traceability and batch records in accordance with Regulation (EC) No 178/2002
  7. Have appropriate product liability insurance covering food products
  8. Can effect a product recall if required by the FSAI or other competent authority

3.3 The 14 EU Allergens

Food Sellers must clearly declare the presence of the following allergens:

  1. Celery
  2. Cereals containing gluten (wheat, rye, barley, oats)
  3. Crustaceans
  4. Eggs
  5. Fish
  6. Lupin
  7. Milk
  8. Molluscs
  9. Mustard
  10. Nuts (almonds, hazelnuts, walnuts, cashews, pecans, Brazil nuts, pistachios, macadamia nuts)
  11. Peanuts
  12. Sesame seeds
  13. Soybeans
  14. Sulphur dioxide and sulphites (at concentrations of more than 10mg/kg or 10mg/litre)

3.4 Alcohol Sales

Sellers of alcoholic beverages must:

  • Hold all required licenses from the Revenue Commissioners and relevant licensing authorities
  • Not sell to persons under 18 years of age
  • Include appropriate alcohol percentage labeling
  • Comply with all advertising restrictions for alcohol products
  • Include health warnings where required by law

3.5 Fresh/Perishable Food (Made-to-Order Collection)

Sellers offering fresh or perishable food for local collection must:

  • Clearly state the collection location and available time slots
  • Ensure products are prepared in accordance with food safety requirements
  • Provide appropriate storage instructions to Buyers at collection
  • Have a clear policy for uncollected orders

4. Disclaimer of Liability

Please Read Carefully: This section limits our liability to you. By using the Platform, you accept these limitations.

4.1 Platform Liability

To the fullest extent permitted by Irish and EU law:

  • We are not liable for any products sold through the Platform, including their quality, safety, legality, or fitness for purpose
  • We are not liable for any injury, illness, allergic reaction, or death arising from the consumption or use of any product purchased through the Platform
  • We are not liable for any foodborne illness, contamination, or adverse health effects from Food Products
  • We are not liable for any inaccurate, incomplete, or misleading product information provided by Sellers
  • We are not liable for any failure by Sellers to comply with food safety or other regulations
  • We are not liable for any loss, damage, or expense arising from the purchase or use of products
  • We are not liable for any disputes between Sellers and Buyers

4.2 Seller Liability

Each Seller:

  • Bears sole responsibility for their products, including safety, quality, and compliance with all applicable laws
  • Is solely liable for any claims, damages, losses, or expenses arising from their products
  • Agrees to indemnify and hold harmless From Local Lámha from any claims arising from their products or conduct

4.3 Buyer Acknowledgement

By purchasing products through the Platform, Buyers acknowledge and agree that:

  • All products are sold by independent Sellers, not by From Local Lámha
  • Any contract of sale is between the Buyer and the Seller only
  • From Local Lámha does not guarantee or warrant any products
  • Buyers with allergies or dietary requirements must verify ingredients directly with Sellers before purchase
  • Buyers assume all risk associated with the purchase and consumption of Food Products
  • From Local Lámha's role is limited to providing the marketplace platform

4.4 Maximum Liability

In the event that liability cannot be excluded, From Local Lámha's maximum aggregate liability to any User shall not exceed the greater of:

  • The fees paid by that User to From Local Lámha in the 12 months preceding the claim; or
  • €100 (one hundred euros)

4.5 Exclusions

Nothing in these Terms shall exclude or limit liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited by Irish or EU law

5. Indemnification

5.1 Seller Indemnification

Each Seller agrees to indemnify, defend, and hold harmless From Local Lámha, its directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

  • Any products sold by the Seller through the Platform
  • Any breach of these Terms by the Seller
  • Any violation of applicable laws or regulations by the Seller
  • Any claim that products are unsafe, defective, or caused harm
  • Any claim relating to intellectual property infringement
  • Any dispute between the Seller and a Buyer

5.2 Food Seller Additional Indemnification

Sellers of Food Products additionally agree to indemnify From Local Lámha against any claims arising from:

  • Foodborne illness or allergic reactions
  • Non-compliance with FSAI regulations or other food safety laws
  • Inaccurate or incomplete allergen information
  • Product recalls or withdrawals
  • Regulatory enforcement actions

6. Dispute Resolution

6.1 Disputes Between Buyers and Sellers

Disputes between Buyers and Sellers should first be resolved directly between the parties. From Local Lámha may, at its sole discretion, provide mediation assistance but is under no obligation to do so.

6.2 Platform Disputes

Any dispute arising from these Terms or your use of the Platform shall be:

  • Governed by the laws of Ireland
  • Subject to the exclusive jurisdiction of the courts of Ireland

6.3 European Online Dispute Resolution

For EU consumers, the European Commission provides an Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

7. Intellectual Property

The From Local Lámha name, logo, and all related branding are trademarks of From Local Lámha. Sellers retain ownership of their own intellectual property but grant us a license to display their product images and descriptions on the Platform.

8. Privacy and Data Protection

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. We comply with the General Data Protection Regulation (GDPR) and the Irish Data Protection Acts 1988–2018.

9. Account Termination

We reserve the right to suspend or terminate any account that:

  • Violates these Terms
  • Engages in fraudulent or illegal activity
  • Receives repeated complaints from Buyers
  • Fails to comply with food safety or other regulatory requirements
  • Damages the reputation of the Platform

10. Changes to These Terms

We may update these Terms from time to time. We will notify Users of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Continued use of the Platform after changes constitutes acceptance of the new Terms.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12. Consumer Rights

Your Statutory Rights: Nothing in these Terms affects your statutory rights as a consumer under Irish and EU law, including the Consumer Rights Act 2022 and the Consumer Rights Directive.

Consumers purchasing from Sellers based in the EU have rights including:

  • The right to clear information before purchase
  • A 14-day cooling-off period for distance sales (with exceptions for perishable goods and custom-made items)
  • Remedies for faulty or not-as-described goods

These rights apply against the Seller, not against From Local Lámha as the Platform provider.

13. Cookies and Analytics Permissions

13.1 Functional Cookies

We use essential functional cookies to ensure the Platform operates correctly. These include cookies that remember your language preference (English, Irish, or Ukrainian) and your session status. These cookies are strictly necessary for the service requested by you.

13.2 Analytics and Performance

With your explicit permission, we use analytics tools to understand how visitors interact with our Platform. These tools help us improve the user experience by collecting anonymous data on page visits, load times, and navigation paths.

13.3 Managing Permissions

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland, except where mandatory consumer protection laws provide otherwise.

Summary: From Local Lámha is a marketplace platform only. All products are sold by independent Sellers who are solely responsible for their products, including food safety and compliance. By using this Platform, you acknowledge and accept these Terms.
